Many employment issues should be able to be resolved without the need for litigation - however, when litigation is required then I have a record I am proud of. I have successfully litigated issues arising from all sorts of employment matters for employers, including (to name a few):
- Successfully defending unjustified dismissal claims (for example, Lata v Oceania Care NZ Ltd and Halwala v Mighty River Power Ltd)
- Successfully defending constructive dismissal claims (for example in Erin Burke v Employers and Manufacturers Association (Northern) Inc, Marsh v Smail and Co Ltd)
- Successfully suing ex-employees for breaching their employment obligations (for example in Product Placement Ltd v Cockburn)
- Successfully defending claims for wages and holiday pay (for example Lange v EFI (NZ) Ltd)
- Successfully striking out grievances brought outside of the 90 day requirements (for example in Russell v Transfield (NZ) Ltd)
- Successfully arguing contractual disputes (for example NZEMPU v New Zealand Automobile Association Inc)
- Successfully arguing employee vs contractor issues (for example in Lowes v Halls Refrigerated Transport Ltd)
- Successfully defending discrimination claims (for example in Parohinog v Yellow Pages Group Ltd)
